Illegal challan imposed

Hi All,

I'm looking for suggestions on this.

I was riding my bike (UP78-AM5349) near Ramwadi, Viman Nagar, Pune on 09/01/09. I was carrying my wife to her office in the morning.

On Ramawadi chauk, when I was crossing the intersection (along with several other vehicles) signal was orange. I repeat signal was orange not red. This traffic wala sipahi stopped me dangerously at the middle of intersection by looking at my UP number plate.

Then he made us crawl to side of the road and started telling me a story about some other UP vehicle. Then he asked for all the papers, which I had including drivers license, insurance, PUC, NOC, road tax paid in Pune RTO. When he found nothing (he lost his chance to make quick bribe money) then suddenly he starting filling Rs 100 challan receipt. I asked what it was for. He said it was for crossing red signal. I said I'll go to court then he started threatening me to seize my vehicle.

Now some interesting things:
He gave me a challan signed by him but name and designation printed on stamp didn't match. He signed on behalf of Mr Bazirao Bhole, sub traffic pollice inspector. His name was though R. B. Kadam. he said he signed on his superior's behalf.

Now I'm thinking of filing a case against him for 3 reasons:
1. He imposed fine in un-authorized way. As far as I know, no sipahi can impose a fine only sub-inspector and above can do that.
2. He stopped me in a very dangerous way in the middle of the road.
3. He challaned me for what I didn't do. My wife is witness here. Also he wrote "fine on account of mv act 119/177' on receipt. I checked online there is no such act. There are similar looking number acts but not this one.

So, My question is how I can register a case against this bad sipahi. Where do I have to file? What's the procedure? How long would it take? Is it worth the time and money?

I think someone has to start these kind of thing. So why not me. Please suggest.

Actually you are right someone should start it ...but then as u said its not worth the time & money ...firstly u have to go to police station then file a FIR then go to court ..& u know bomb blast cases in this country last for decades so anyways that sipahi is going to retire from his service until ur case is over ..so i don't think its worth doing..
Instead if u want to do something i think u should write a letter with all details to the RTO head & ask for explanation ..& if there is no answer from him then file a RTI( Right to information) ...this is much simpler way & it may work ... & not only for that sipahi ..they may issue some instructions to all of them ..so u may improve the whole system
